Terms of Service

Business Eligibility provides business financing eligibility analysis services through a tiered product structure. For a fee, we:

1. Collect information and documentation about your business
2. Analyze your business profile against the eligibility criteria of our network of lender and banking partners
3. Generate a written Eligibility Report identifying financing programs your business may qualify for, estimated terms and rates, and recommended next steps
4. (For Full Membership customers) Provide access to our training modules, dashboard, calculators, simulators, and other educational tools
5. Optionally refer you to financing partners — including our affiliate Integrity Cap and its 75+ lender partners — for further evaluation

To use the Services, you must:

1. Be at least 18 years of age
2. Be a U.S. resident or authorized representative of a U.S.-based business
3. Have the legal authority to share business and personal information about the business you represent
4. Have the legal authority to enter into these Terms on behalf of yourself and (if applicable) your business
5. Not be barred from receiving financial services under U.S. law (including OFAC sanctions lists)

To purchase the Services, you must create an account. You agree to:

1. Provide accurate, current, and complete information
2. Maintain the security of your password and account credentials
3. Promptly notify us of any unauthorized access or security breach
4. Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

Approved refunds are processed within 10 business days to the original payment method. After 30 days, all sales are final.

To deliver an accurate Eligibility Report, we rely on the information and documentation you provide. You agree to:

1. Provide accurate information. All information and documentation submitted must be truthful, accurate, and complete.
2. Provide your own documents. You may only submit documents that you own or are authorized to submit. Submitting forged, altered, or fraudulent documents is a violation of these Terms and may constitute a federal crime.
3. Cooperate with our process. Respond promptly to requests for additional information or documentation. Failure to respond within 30 days may result in your file being closed.
4. Update us. Notify us promptly if any information you have provided changes during the analysis period.
5. Use the Services lawfully. Do not use the Services to commit or facilitate fraud, money laundering, or any other illegal activity.

1. No loan approval. The Eligibility Report is an analytical assessment based on the information you provide and the eligibility criteria of our partner network at the time of preparation. It is not a loan offer, commitment, pre-approval, or guarantee of approval.
2. Lender discretion. All lending decisions are made by independent third-party lenders based on their own underwriting standards. We do not control, and are not responsible for, lender decisions.
3. Estimates only. Any rates, terms, funding amounts, or timelines mentioned in the Eligibility Report are estimates based on lender published criteria. Actual rates and terms will be determined by the lender during underwriting.
4. Changing criteria. Lender eligibility criteria, rates, and program availability change frequently and without notice. The information in your Eligibility Report reflects the criteria available to us at the time of preparation.
5. No guarantee of funding amount or terms. Even if you are approved by a lender, the actual funding amount, rate, or term offered may differ from what is estimated in your Eligibility Report.
6. The Funded Promise. If you purchase the Full Membership and subsequently fund a loan through Integrity Cap, your Membership investment will be credited toward your financing fees as described in the marketing materials at the time of your purchase. The Funded Promise applies only to deals funded through Integrity Cap and is subject to the specific lender's fee structure for your transaction.

The Eligibility Report, video modules, calculators, simulators, templates, and any communications from us are for informational purposes only and do not constitute:

• Investment advice
• Legal advice
• Tax advice
• Accounting advice
• A recommendation to enter into any specific financial transaction

By purchasing the Services, you consent to Business Eligibility sharing the information and documentation you submit with:

1. Our affiliate Integrity Cap for the purpose of presenting financing options through its lender network
2. Our affiliate IntegriTech.ai for the purpose of pipeline management and processing
3. Lender and banking partners for the purpose of pre-qualification and underwriting evaluation
4. Service providers acting on our behalf

By providing your contact information, you agree to receive communications electronically, including by email, telephone (including SMS/text), and through the Site. You consent to:

• Receive transactional communications (account, purchase, and report-related)
• Receive marketing communications from Business Eligibility and our affiliates (you may opt out at any time)
• Have all required disclosures, notices, and agreements delivered electronically pursuant to the federal E-Sign Act

You may not:

1. Use the Site or Services for any illegal purpose or in violation of any applicable law
2. Submit false, misleading, or fraudulent information
3. Impersonate any person or entity or misrepresent your affiliation with any person or entity
4. Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' accounts
5. Use any automated means (bots, scrapers, crawlers) to access the Site without our written permission
6. Interfere with or disrupt the Site, including by introducing viruses or malicious code
7. Use the Site to transmit unsolicited communications, advertising, or spam
8. Reverse engineer, decompile, or disassemble any portion of the Site
9. Share account credentials or allow multiple users to access a single Membership
10. Use the Services to compete with us or to develop a competing product

The Services may include links or referrals to third-party websites, lenders, or service providers, including our checkout processor at mybusinesseligibility.com. We do not control these third parties, and we are not responsible for their products, services, content, or practices.

If you proceed with a lender we refer you to, your relationship with that lender is governed by the lender's own agreements, terms, and disclosures. We are not a party to any loan agreement between you and a lender.

To the fullest extent permitted by law, we disclaim all warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties arising from course of dealing or usage of trade
• Warranties that the Site will be uninterrupted, secure, error-free, or free of viruses
• Warranties regarding the accuracy, reliability, or completeness of the Eligibility Report or Services
• Warranties that you will obtain financing as a result of using the Services

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.

1. In no event shall Business Eligibility LLC, our affiliates, or our officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, or business interruption — even if we have been advised of the possibility of such damages.
2. Our total cumulative liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
3. Lender outcomes excluded. We are not liable for any decision made by a lender or for any rates, terms, or conditions offered (or not offered) to you by a lender.

You agree to indemnify, defend, and hold harmless Business Eligibility LLC, our affiliates, and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

1. Your violation of these Terms
2. Your violation of any law or the rights of a third party
3. Information or documents you submit (including any inaccuracy or fraudulent content)
4. Your use of the Services or the Eligibility Report
5. Any financing transaction you enter into (or fail to enter into) with a third-party lender

We may update these Terms from time to time. We will post the updated version on the Site and update the "Last Updated" date. Material changes will be notified by email or prominent Site notice and will take effect 30 days after notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree, your sole remedy is to stop using the Services.
